These Terms of Use (“Terms”) govern your access to and use of luxurylivingprescott.com and any related pages, services, tools, or communications (collectively, the “Site”). By accessing or using the Site, you agree to these Terms and to our Privacy & Consumer Protection Statement.

1) Who we are
Brookshire & Associates LLC is an Arizona real estate brokerage located at 3623 Crossings Dr., Suite 272, Prescott, AZ 86305. Phone: 928-458-1403. Use of the Site does not create a brokerage relationship; a written agreement is required to engage our services.

2) Eligibility & account security
You must be at least 18 years old to use the Site. If you create an account or save searches, you are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

3) Acceptable use
You agree not to:

• Interfere with the Site’s operation or security;
• Scrape, harvest, or index the Site or its data without written permission;
• Use the Site for any unlawful, misleading, or fraudulent purpose;
• Misuse MLS/IDX data (see Section 7).

4) Communications consent
If you submit your contact information, you authorize us to contact you by email, phone, and/or text regarding real estate services. Text/SMS: Reply STOP to opt out, HELP for help. 5) Privacy
Your use of the Site is also governed by our Privacy & Consumer Protection Statement, which explains what we collect, how we use it, and your rights (including CPRA). By using the Site, you agree to that policy.

6) Intellectual property; license to use the Site
The Site’s content—including text, logos, graphics, photographs, video, and code—is owned by us or our licensors and protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial home-search and informational purposes. Any other use (including copying, scraping, resale, or derivative works) is prohibited without our written consent.

7) MLS/IDX data and third-party services
Property listings and related data may be provided by an MLS/IDX vendor and are for personal, non-commercial use only. Information is deemed reliable but not guaranteed and may change without notice. You may not redistribute or use MLS/IDX data for any purpose other than viewing properties for potential purchase or sale. The Site may link to third-party services (e.g., listing widgets, maps, scheduling, video). We do not control and are not responsible for third-party content, terms, or privacy practices.

8) User content & testimonials
If you submit content (e.g., reviews, photos, questions, testimonials), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such content in connection with the Site and our business. You represent that you own or have the rights to the content you submit.

9) No legal, tax, or financial advice
Content on the Site is for general information only and is not legal, tax, financial, or professional advice. Consult appropriate professionals for advice tailored to your situation.

You agree to indemnify and hold harmless Brookshire & Associates LLC and our members, managers, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or violation of these Terms.

13) Governing law & venue
These Terms are governed by the laws of the State of Arizona, without regard to conflicts principles. Exclusive venue lies in the state or federal courts located in Yavapai County, Arizona. You consent to personal jurisdiction in those courts.

14) Changes to the Site or Terms
We may update these Terms from time to time. Changes will be posted with an updated “Effective date.” Your continued use of the Site after changes are posted constitutes acceptance.
