Brookshire & Associates LLC is committed to protecting your privacy, honoring consumer rights, and using your information responsibly. This Statement explains what we collect, how we use it, when we share it, your choices, and your rights under applicable laws.

1) What We Collect (Personal Information)
We collect information in three ways: (a) directly from you, (b) automatically from your device, and (c) from third parties (e.g., MLS/IDX feeds and advertising partners).
A. You provide:
• Contact details (name, email, phone, mailing address).
• Home search preferences (price range, beds/baths, neighborhoods).
• Messages and inquiries sent via website forms, email, or text.
• Transaction details if you engage us for real estate services (e.g., property address, agreements, closing info).
• Marketing preferences (email/SMS consent, opt-outs).
B. Collected automatically:
• Device/usage data (IP address, browser type, pages viewed, date/time, referring URLs).
• Cookies, pixels, tags, analytics IDs, and advertising identifiers.
• Approximate geolocation (if enabled in your device/browser).
C. From third parties:
• MLS/IDX providers (listing data you view or save).
• Lead sources/portals, social media platforms, and advertising networks.
• Public records and service providers (e.g., fraud prevention, analytics).
2) Why We Use Your Information (Purposes)
• Provide real estate services you request (property searches, scheduling showings, market analyses, listing/transaction services).
• Customer care & communications (responding to inquiries; sending updates, alerts, and service notices).
• Marketing & personalization (newsletters, market updates, new listings, remarketing/retargeting where permitted).
• Website functionality & analytics (security, debugging, performance, usage metrics).
• Legal, compliance, and safety (contract enforcement, record-keeping, fraud prevention, and regulatory requirements).
3) How We Share Information
We share personal information only as necessary and consistent with this Statement:
• Service providers (website hosting, CRM, email/SMS platforms, analytics, customer support, document management).
• MLS/IDX & real estate partners (to show, save, or share listings, coordinate showings, or complete transactions).
• Advertising/analytics partners (for measurement and, where permitted, targeted advertising/retargeting).
• Legal & compliance (to comply with law, enforce agreements, or protect rights, property, and safety).
• Business transfers (in a merger, acquisition, or asset sale, subject to this Statement).
We do not sell your personal information for money. We may “share” personal information as defined by CPRA for targeted advertising unless you opt-out (see Section 8).
4) Your Choices
• Email marketing: Unsubscribe via the link in our emails or contact us.
• SMS/texts: Reply STOP to opt-out; HELP for help. Message/data rates may apply.
• Cookies & ads: Use our cookie banner (if present) to adjust preferences or set browser controls to block/clear cookies. Some features may not function without cookies.
• Do Not Track: We currently do not respond to DNT signals due to industry standards variability.
5) Data Security & Retention
We use administrative, technical, and physical safeguards appropriate to the sensitivity of the data. No method of transmission or storage is 100% secure. We retain data only as long as needed for the purposes described (e.g., to provide services, meet legal/record-keeping obligations, resolve disputes, and enforce agreements).
6) Children’s Privacy
Our website and services are not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us personal information, contact us and we will delete it.
7) Communications Compliance (TCPA/CAN-SPAM)
By providing your phone number and clicking submit or otherwise requesting contact, you consent to be contacted by us (and our agents) via call or text at the number provided, including by automated technology, about real estate services. Consent is not required to purchase services. You may opt-out at any time as described in Section 4. Emails will always include an unsubscribe option.
8) California Notice at Collection & CPRA Rights
NOTICE AT COLLECTION (Summary):
We collect the following categories of personal information: identifiers (e.g., name, email, phone, IP), commercial information (services requested, saved homes), internet/usage data (cookies, analytics), geolocation (approximate), inferences (preferences), and professional information (if relevant to transactions).
Purposes: See Section 2.
Retention: We keep information only as long as needed for the purposes disclosed or as required by law (see Section 5).
Selling/Sharing: We do not sell personal information for money. We may share personal information with advertising/analytics partners for cross-context behavioral advertising.
Opt-Out of “Sale”/“Sharing”: Use our cookie preferences link/banner if available or email privacy@luxurylivingprescott.com with the subject “Do Not Sell or Share My Personal Information.”
Right to Know/Access, Correct, Delete, and Limit Use of Sensitive PI: California residents may request:
• Access (a copy of the personal information we maintain about you),
• Correction of inaccurate information,
• Deletion (subject to legal exceptions),
• Opt-out of sale/sharing (as above).
We do not use or disclose sensitive personal information for any purpose requiring a “limit” under CPRA.
How to Exercise Your Rights: Email privacy@luxurylivingprescott.com or call 928-458-1403. We will verify your request (we may need information to confirm your identity). You can designate an authorized agent to act for you with written permission. We will not discriminate against you for exercising your rights.
Nevada Residents: You may submit a request not to sell your personal information at luxurylivingprescott.com (we do not sell personal information for monetary consideration).
9) Cookies & Similar Technologies
We use cookies, pixels, and tags for site functionality, analytics, and (where permitted) advertising. You can manage preferences via our cookie banner (if available) or your browser settings. Third-party cookies from analytics and ad partners may track your activity across sites for measurement and targeted ads. See Sections 4 and 8 for opt-out options.
10) IDX/MLS & Third-Party Links
Property listing data (photos, descriptions, and related information) may be provided via an MLS/IDX vendor and is subject to their terms and policies. Our site may link to third-party websites or tools we do not control. We are not responsible for their content or privacy practices. Review their privacy notices before providing personal information.
11) Changes to This Statement
We may update this Statement from time to time. The “Effective date” will show the latest version. Material changes will be posted on this page and, where required, we will notify you through additional means.
